(1) The appellant, Chih I. Woo, was convicted after a Bench trial in the Superior Court of possession of cocaine in violation of 16 Del.C. Γ§ 4753. Woo unsuccessfully moved to suppress the evidence seized from his person following his arrest along with three other individuals in a parking lot in Newark. The trial Judge ruled that suspicious circumstances then present provided the arresting officers with the basis to form a reasonable albeit mistaken belief that Woo was in possession of marijuana.
